Abstract

This thesis examines Danish legislation in relation to European Convention on Human Rights (ECHR). Given that Denmark had a blasphemy paragraph until 2017, this study compares the new legislative proposal from 2023 with the 2017 proposal that revoked the blasphemy law. The comparison is conducted using elements of the ECHR to analyze. The primary sources of material are doctrinal writings on the European Court of Human Rights (ECtHR) and doctrine writings on the legislative proposals themselves. The use of doctrinal sources over actual judicial materials is due to the social science orientation of this thesis. The thesis concludes that while the differences between the two legislative proposals are evident, it is interesting that they exhibit significant similarities despite their distinct objectives. Both proposals are required to align with the ECHR. However, their primary focuses differ: the new proposal seems to emphasize the protection of religion more than the previous proposal, whereas the previous proposal prioritized the protection of freedom of speech.
